Record Brain and Spinal Injury Payout Goes to 9-year-old Boy

The 9-year-old boy who was accidentally run over by his own father while on a family outing was finally awarded compensation worth a staggering £8.1 million in today’s currency. This record-setting amount was a court-approved award for the child who will need lifelong care.

After suffering severe spinal and brain injuries in March of 2002 when he was just two-and-a-half years old, the boy is left with severe physical and mental limitations and is dependent on a wheelchair.

A NY Brain Injury Attorney remembers that the incident happened on a family trip to Mead Open Farm, near Leighton Buzzard, Bedfordshire. The boy’s father failed to see him, and when he reversed the car, he drove over the toddler.

The boy’s attorney reported to the presiding Justice at the High Court in London that the boy’s father’s insurers, who earlier admitted liability, had made a payment of £1.7 million to enable the family to buy a home suitable for the special needs of the child. This amount was a prior amount, and according to the current data that is available, it is extraneous to the court’s recent decision.

The child’s attorney also provided documented evidence of the child’s current needs and their costs. A Manhattan Brain Injury Attorney said that the settlement entailed a massive £2.5 million lump sum payment in addition to annual payments in the amount of £220,000.

The judge was quoted as saying, “I am amazed and admiring of the care – not only the physical care but the thought and consideration of the family – which has gone into [the boy’s] upbringing,” she said. “It is quite clear that, although he is in many ways a delightful boy, he can be difficult on occasions, and I have no doubt that considerable patience, forbearance and hard work is required to deal with that.

“I wish him, and the family as a whole, well for the future and, while this order cannot possibly put him back to the circumstances in which he otherwise would have been, I hope it will play its part in enabling him to live to his full potential and assist the family in the difficult task of providing for his future.” New York City and Queens treat these situations very seriously when it comes to law suits.

The boy now lives in with his mother and her new husband in Milton Keynes. He has a twin brother and 7-year-old twin siblings. The mother reports being happy that the case is over and knowing that her son can be properly cared for throughout the rest of his life.
